Under the Regulation landlords cannot lock out or evict eligible tenants without first negotiating rent relief and going to mediation. I would like to work with you to negotiate what arrangements we can make to help us get through this period.
I enclose documentation to demonstrate my business meets the eligibility criteria outlined in the Regulation:
Evidence we qualify for the NSW Government’s Micro-business COVID-19 Support Grant/ COVID-19 NSW Business Grant / Job Saver Grant (select appropriate), and
have an annual turnover of under $50 million in the 2020-21 financial year.

I am writing to you to negotiate the terms of your commercial lease agreement at [property address], if your business is impacted due to the current COVID-19 public health orders.
If you believe you are eligible under the Retail and Other Commercial Leases (COVID-19) Regulation 2021, please provide evidence of your eligibility and calculations of your decline in turnover, including:
Evidence you qualify for either the 2021 COVID-19 Micro-business Grant, the 2021 COVID-19 Business Grant, or the JobSaver Payment, and
Evidence of an annual turnover of less than $50 million in the 2020-21 financial year (e.g. Tax return or BAS).
This will help us both to understand what kind of arrangements we can make that comply with the Regulation.
If you don’t think you’re eligible, it’s still a good idea to negotiate. We can become clearer on your leasing arrangement and plan ahead. Negotiating will also ensure the best longer-term outcomes for us both. There are several other terms we can consider negotiating in addition to, or instead of, rent. For example:

options
permitted uses of the property
